Federal Court suspends Agency's restriction on the publicity of food and non-alcoholic beverage

Last july, the National Agency of Sanitary Surveillance (Agência Nacional de Vigilância Sanitária - ANVISA) enacted a resolution that restricts the publicity of food and non-alcoholic beverage and obliges the manufacturers to display words relating their products to heart diseases, high blood pressure, diabetes, obesity and dental cavity. Recently, however, Judge Gilda Sigmaringa Seixas, of the 16th Federal Court for Brasília (1st instance), suspended the resolution on the grounds that not only had it been ultra vires but also violated statutory standards concerning the matter, among other reasons. A legal opinion released by the Federal Attorney General's Office (Advocacia-Geral da União - AGU) had already recommended the resolution be suspended by the ANVISA, on the same grounds.
About the decision, Professor Luís Roberto Barroso, who is counselor of the plaintiff, the Brazilian Association of Food Manufacturers (Associação Brasileira das Indústrias de Alimentos - ABIA), said: "Freedom of expression includes freedom of press, creation and publicity. Publicity is necessary for public information as well as for free competition. In specific cases, the Constitution admits certain restrictions to this freedom, as long as they are embodied in statutory provisions, after deliberation and voting in the National Congress. Restrictions to the freedom of expression based on executive agency's acts could never be allowed, for that equates with censorship.

O Instituto IDEIAS (www.institutoideias.org.br) is a private nonprofit association which was established to foster legal research in Brazil, among other purposes. In order to achieve that, the institute has recently created an academic award called "Prêmio Mérito Acadêmico Instituto IDEIAS".
